FERC is now "sanitizing" eFiling Comment Descriptions, removing criticism of the FERC process in the highly-visible Comment Description listings. FERC personnel and the new — but obscurely located — notice regarding eFilings indicate that no "editorializing" is allowed in Comment Descriptions. FERC personnel's stated justification is that this policy disallows libelous statements and/or personal attack in the Description; however, they state that the Comments themselves are the appropriate place for such "editorializing." While removal of libel, personal attack, course language, and the like are appropriate, there is no justification for FERC using a heavy hand to reduce visibility of criticism against inappropriate FERC processes.
