How Can I Submit Comments or an Intervenor Registration?

Requirements & Suggestions

Anyone can submit comments to FERC during the formal filing process.

Intervening

Registering as an Intervenor must take place within 21 calendar days of the Formal Filing application submission to FERC.
Intervenor Registration deadlines:

Downeast LNG2007 January 22
Note that each LNG project has multiple separate Dockets. You may want to register as an intervenor with specific individual dockets or with all dockets. Each docket requires separate Intervenor registration; however, the same Motion to Intervene letter can be used for all dockets, if all docket numbers are listed at the head of the letter, and the same letter is sent to each docket, or if one letter is mailed by post. eFiling Online

From the FERC website:

eFiling is a file attachment process. Prepare your submission in the same manner as you would if filing on paper. If you're filing in a docketed proceeding(s), the document you submit must include the docket number(s) applicable to your submission. All documents must include the name and address of the person responsible for the filing.

The Commission does not accept comments or other documents on proceedings via email.

While it is possible to submit proprietary software documents (i.e., created as Microsoft Word documents), submitting documents in Rich Text Format (RTF), or in Adobe Portable Document Format (PDF) will make the files more universally accessible, speeding up their posting in the eLibrary.

(FERC's eLibrary will attempt to generate — and make available, along with your original submission — a unified PDF file from all the files within your submission. That offers the public a choice of downloading the original files as individual files in their original format, or as a unified PDF. Note that the FERC eLibrary cannot generate PDF files from some file formats. In such cases, an error page will be generated. If you've downloaded such a file, you may want to download the file separately in its original format. In our experience, some types of files from which FERC has difficulty generating a PDF: Microsoft Works, image-only PDF files, Adobe Acrobat 1.4 PDF files, non-MS Word text documents that are not saved as RTF or PDF files.)

How Can I Submit Comments or an Intervenor Registration?

Read the eFiling Online information above.

First, you must register with FERC (see below).

Then, you may submit comments as files, by uploading via the FERC eFiling special procedure. Submitting an Intervenor Registration uses the same procedure. (It is too late to file as an intervenor in the Downeast LNG or Calais LNG proceedings; however, anyone — even non-intervenors — can file comments to the docket.)

Register to Intervene ONLY on Formal Filing Dockets. DO NOT register as an Intervenor to a Pre-filing docket, since Pre-filing dockets do not recognize Intervenor status. (Calais LNG and Downeast LNG are no longer in Pre-filing; they are in Formal Filing.)

Prepare your comments or Intervenor Registration within files (RTF and PDF are the most universally-readable file formats) to be uploaded prior to using the process described below. Be sure to include the Requirements and Suggestions provided above. You are limited to 10 files per submission, 10 MB per file.

Please submit fact-based comments. Emotional comments may actually be counter-productive, or may simply be ignored.

You may want to print these instructions, in order to use them as a guide while submitting your comments.

  1. Read the eFiling User Guide.
  2. Register as a New User in the FERC online system.
    1. Federal Energy Regulatory Commission > Documents & Filing > FERC Online > eRegistration > New User? eRegister
      (For subsequent file submissions, on the same page, go to eFiling > Login)
    2. You'll be required to supply the following information:

      Email Address Example: John.Doe@somewhere.com
      2. Password Example: 1xh2yz3a
      "Note: Password should be between 8 and 12 characters and contain at least one numeric, hyphen "-", or underscore "_".
      3. Password Hint (Use a hint that's appropriate for your chosen password.)
      Important: Keep track of your password. You'll need it each time you make a submission.
    3. Once you've registered, then from the FERC Online page, you can...
      1. Login using your email address and password
        1. eComment: This is not the link to use to submit your comments.
        2. eRegister:
        3. eFiling: Submit Comments to Formal Application Dockets;
          [NOTE: Anyone can submit Comments.]
        4. eSubscription: Receive emails notices when Dockets are updated;
        5. eService: View the mailing list for a particular Docket;
        6. eLibrary: Access Docket pages (Read/Download Docket Documents)
  3. eFile Your Comments or your Intervenor Application.
    1. Federal Energy Regulatory Commission > Documents & Filing > eFiling: Submit Comments to Formal Application Dockets
      1. Existing User: Log In
      2. Click on link: eFiling to Begin
      3. Filing Type Selection page, under, "How is your filing to be directed?" click on…
        1. General
      4. Under "What kind of filing are you making?" and depending on the type of filing you are making, select
        • Comment (on Filing, Environ. Report, or Tech Conf.) ; or
        • Intervention (INTERVENTION IS NOT COVERED IN THESE INSTRUCTIONS AT THIS TIME.)

        …and click the "Next" button.

      5. On the resulting "Select Docket" page, under the "Search" tab (ignore the "Quick Entry" tab)…
        • Enter the first Docket Number for your filing. (Entering multiple docket numbers requires multiple steps, shown below.) Docket numbers for Downeast LNG are…

          • CP07-53
          • CP07-54
          • CP07-55
        • Click the Search button.
        • New information will appear below the field where you entered the Docket number.
        • If the Docket number is correct (it will be appended with "-000", as in "CP07-52-000"), click the large light blue + (plus) symbol.
        • The same Docket information will appear in the "Selected Dockets" window of the page.
        • If entering multiple Docket numbers, go up to the "Enter Docket Number" field, enter the new Docket number, and repeat the same steps as described above.
        • When all Docket numbers have been entered and selected, click the Next button.
      6. You will be taken to the File Upload page.
      7. On the File Upload page, be sure the Public tab is selected. Click the Choose File button. You'll be presented with a navigation window on your computer. (Do you remember where you saved your files? Do you remember the order in which you want readers to view them?)
      8. Navigate to the first file you wish to submit, and Select the file. The file will upload, and filename and description of the file you selected will appear in the Files Loaded - Public 1 window in the Public tab.
      9. Repeat the procedure for each file you wish to submit.
      10. Then, click the Next button. You'll be taken to the Specify Filing Parties page.
      11. Select the appropriate radio button: On behalf of another Party(ies) or As an Individual.
        1. If you selected As an Individual, then click the Next button.
          1. On the resulting Specify the person to whom communication should be addressed page, enter your Email address, and click Add as Signer button if you are filing your own Comment. If you are filing for another person, click Add as Other Contact. Your email address will appear in a new window below the field used to enter your email address. Click the Next button.
          2. You will be presented with the Submission Description window. The Description field will already contain some text (e.g., Comment of [Your Name] under CP07-52-000.). You may want to add more description to that text; however, DO NOT MAKE SUBJECTIVELY JUDGMENTAL STATEMENTS, since doing so may result in FERC editing your description. Click the Next button.
          3. You will be presented with the Summary page. THIS IS YOUR LAST OPPORTUNITY TO ABORT, OR TO BACK UP TO CORRECT YOUR SUBMISSION. If the information displayed is correct, click the Submit button and your Comment will be formally submitted.
             
            THE SUBMISSION IS COMPLETE.
             
            You'll receive a confirmation shortly thereafter from the FERC eLibrary that your submission has been received. Although you'll be able to view the file(s) you just submitted (via a link included in the confirmation), the filing won't be available in the eLibrary to others until FERC has officially posted the filing, which may be a day or two.  
             
        2. If you selected On behalf of another Party(ies), go to the next item in this list.
           
      12. If filing On behalf of another Party(ies), then Enter the name you used to register with FERC. When you start typing, the field may automatically complete the name. Click the Search button.
      13. A list of names (possibly only one name — yours) will appear below the name field. Click the large light blue + (plus) symbol next to the correct name. The name you indicated will appear in a Selected Organizations or Selected Names window below the above-mentioned list. Click the Next button.
      14. You will be presented with the Specify the person to whom communication should be addressed page. Enter the appropriate email address and Click either the Add as Signer or the Add as Other Contact button. The associated information will appear in a new table below what you just entered. If it is correct, click the Next button.
      15. You will be presented with the Submission Description window. The Description field will already contain some text (e.g., Comment of [Your Name] under CP07-52-000.). You may want to add more description to that text; however, DO NOT MAKE SUBJECTIVELY JUDGMENTAL STATEMENTS, since doing so may result in FERC editing your description.
