Filed By: Sunrise County Economic Council
Filed Date: 6/8/2009
Accession No: 20090608-5082
Description: Comment of Sunrise County Economic Council NOT to extend Public Comment period for dockets CP07-52, et al. We feel it is best for our community and all parties involved to remail with original timeline of Public Commment period.

Information: FILE LIST

Webmaster’s Comments: Sunrise County Economic Council (SCEC) ignores that the 1,436-page (including appendices) Draft Environmental Impact Statement (DEIS) was just released. The DEIS contains material — a lot of it new to the public, or presented in new ways — from numerous agencies. Our request to extend Public Comment has to do with commenting on the DIES contents, not on what Downeast LNG previously filed.

SCEC also ignores that the FERC process favors the applicant, to the disadvantage of the public.

The DEIS comment period is intended to provide the public with adequate opportunity to submit thorough and accurate comments, in order to facilitate an accurate final EIS. We are asking for that opportunity

Filed By: INDIVIDUAL [William Howard]
Filed Date: 6/12/2009
Accession No: 20090616-0121
Description: Comments of William W Howard re the Downeast LNG Project under CP07-52 et al.

Information: FILE LIST

Webmaster’s Comments: Mr. Howard opposes SPB’s request for an extended DEIS Comment time period, stating SPB’s reasons for the request are “a complete falsehood.” He also claims the predominant area tourist attraction was the now-closed Downeast Heritage Center. He further claims most area employment is from government, forest product industries, health services, the educational system, grocery stores, convenience stores, and Walmart — not fishing and tourism.

He argues that the project hasn't changed over its four years, so apparently there is no need to read and critique the DEIS.

Howard criticizes the SPB researcher and webmaster for spending time building and maintaining the SPB website and for commenting on LNG news articles in Maine and Canada.

He accuses SPB of asserting falsehoods to achieve its goals.

Note: Government (Customs & Immigration), the educational system (Elderhostel programs), grocery stores, convenience stores, and Walmart also serve tourists.

Filed By: INDIVIDUAL [Dan Spear]
Filed Date: 6/12/2009
Accession No: 20090616-0125
Description: Comments of Dan Spear re the Motion to FERC for enlargement of the comment period filed on behalf of Save Passamaquoddy Bay and other parties under CP07-52 et al.

Information: FILE LIST

Webmaster’s Comments: Mr. Spear opposes extending the DEIS Comment period. He claims the public has already spoken in both Robbinston and Calais. He also claims burning LNG doesn’t pollute.

The Downeast LNG and Calais LNG projects would subject thousands of area residents outside of Calais and Robbinston to Federal Hazard Zones from transiting LNG ships.

Filed Date: 6/12/2009
Accession No: 20090616-0126
Description: Comments of Tom Mohollard (sic) re Save Passamaquoddy Bay Motion to FERC for extending the Downest LNG Project under CP07-52 et al.

Information: FILE LIST

Webmaster’s Comments: Mr. Moholland opposes extending the DEIS Comment period, claiming it would place a hardship on people needing jobs. He claims LNG tax revenue is needed, since the town experienced a forest fire that cost the town $90,000. He claims SPB’s motion for an extension contains little factual data, in part because SPB has never asked the Town of Robbinston for information.

Description: Supplemental Information of Save Passamaquoddy Bay-U.S., et. al. under CP07-52, et al.

Information: FILE LIST

Webmaster’s Comments: This is a rebuttal to Downeast LNG’s opposition to SPB’s request to expand the Public Comment Period.

The purpose of the public comment period “is intended for review and response to the DEIS, the specific contents of which are unavailable prior to the start of the comment period.” Extending the Comment Period will do no harm since DeLNG still has not entered the State of Maine permitting process — a process that generally takes about one year.

Delaying FERC’s process that is scheduled to end on 2009 December 16 for an additional 90 days will still end the FERC process well before the State of Maine permitting process concludes. No one is harmed by extending the Comment Period.

Filed By: INDIVIDUAL [Dale Wing]
Filed Date: 6/15/2009
Accession No: 20090617-0015
Description: Comments of Dale Wing re the Motion to FERC for enlargement of the comment period filed on behalf of Save Passamaquoddy Bay are Downeast LNG Project under CP07-52 et al.

Information: FILE LIST

Webmaster’s Comments: Mr. Wing opposes extending the DEIS Comment Period. He states he and his wife will not be opening the Downeaster Motel this year because “it's a lot of work for very little reward.” He goes on to claim, “The tourist season that is discussed in the Motion is far different from the reality of Eastern Washington County tourism. They must be thinking of the tourist season in VERMONT.” He believes SPB’s motion is completely without merit.

Accession No: 20090622-0173
Description: Comments of Robert J Peacok expressing concerns re the development of the Downeast LNG Terminal under CP07-52 et al.

Webmaster’s Comments: Mr. Peacock says, “Irving started the planning and permit process at the same time as Downsast LNG. Canada can produce an operational terminal even before we can get through the permitting process here In the USA.”

Peacock got it wrong. Canaport began working on their LNG terminal project in 2001 — Downeast LNG did not begin until 2004, according to the Downeast LNG website.

Description: Comments of Stanley Morrell re LNG under CP07-52 et al.

Summary: Mr. Morrell believes the LNG pier would be good for fish species, and that an LNG ship would not harm species populations. He states he could easily schedule his lobster and crab fishing around LNG ship transits. He believes the pipeline would have no long-term negative impacts.

Filed By: CITY OF CALAIS
Filed Date: 6/19/2009
Accession No: 20090622-0176
Description: Comments of City of Calais re liquefied natural gas facility development under CP07-52 et al.

Summary: The City Council unanimously support an LNG facility in Washington County, and believes it is needed by the nation, as well as county and state. They accuse Canada of attempting to circumvent the FERC process, and claim the right of “free passage” (sic).

Webmaster’s Comments: Support for an LNG terminal in Washington County is significantly different than a terminal in Passamaquoddy Bay, where even LNG industry best practices cannot be satisfied. The City Council also ignores the US lack of membership in UNCLOS, meaning the US has no right of innocent passage under that treaty.

Filed Date: 6/19/2009
Accession No: 20090622-0178
Description: Comments Gerald S Morrison re Downeast LNG Project under CPO7-52 et al.
[Summary: Mr. Morrison wrongly claims LNG opponents “like to pretend large ships have never been a cultural or historical part of this area.” He agrees Downeast LNG would impact weir fishing at Mill Cove, but that his family will be compensated for any loss. He ridicules SPB’s previous statement that most supporters of the LNG projects do not live in the Federal Hazard Zones. He also likens a propane truck passing his house to the LNG ship Hazard Zones.]

Webmaster’s Comments: LNG proponents claim that most of the Washington County population supports the LNG projects. If that is so, and regarless of where Mr. Morrison lives, then most supporters live outside the Hazard Zones, and would not be subjected to the associated risks, making SPB’s statement correct.

The Federal Government does not categorize propane trucks as official Hazard Zones, meaning the Government recognizes the potential hazards associated with LNG ships as being significant.

Filed By: INDIVIDUAL [Jon Stanhope]
Filed Date: 6/18/2009
Accession No: 20090622-0115
Description: Comments of Jon Stanhope re Downeast LNG Project CP07-52 et al.

Information: FILE LIST

Webmaster’s Comments: Mr. Stanhope falsely complains that no SPB members attended Town of Robbinston Downeast LNG Committee meetings (DeLNG Advisory Committee meetings?).

Also, he makes the bald claim, "During this time, it was discovered members of SPB were told by their leadership not to attend the Town meetings. In fact, they used the Town's posted schedule for the meetings, to hold their own at the same time, just to ensure there was no dissention among their ranks…."

He also mistakenly claims expanding the DEIS Comment Period would delay completion of the terminal construction. The 90-day extension would expire prior to Downeast LNG obtaining the required State of Maine permits. State permits are required prior to commencing terminal construction.

Then, of course, is the reality that the project will never be built.

Description: Comments of FundyCulture Museum Network re the Draft Downeast FERC Environmental Impact Statement & the Impact of LNG on Cultural Resources in Passamaquoddy Bay under CP07-52 et al.

Webmaster’s Comments: FundyCulture Museum Network states: The network receives 250,000 visitors per year who are seeking cultural and natural experiences. An LNG facility would jeopardize existing businesses and economy. Such projects should be located in industrial zones. Accidents are unpredictable and do happen, so the DEIS assurance that an accident is an unlikely event is inappropriate and circular logic.

Accession No: 20090625-0023
Description: Comments of Peter Cannon re Downeast LNG Project of the Draft EIS Public Meeting under CP07-53 et al.

Webmaster’s Comments: Mr. Cannon wants the Final EIS to specify the regulators’ safety inspection schedule of the terminal if it is built. He would also like the EIS to specify that the Town of Robbinston and State of Maine will not be legally liable once the terminal lifespan expires.

Filed By: MAINE HISTORIC PRESERVATION COMMISSION
Filed Date: 6/24/2009
Accession No: 20090629-0026
Description: Maine Historic Preservation Commission submits its response to FERC's recent request to continue consultation the Downeast LNG, Inc et al under CP07-52 et al.

Summary: They concur with DEIS Section 4.10 Cultural Resources pages 4-282 through 4-293.

They are still awaiting previously-requested surveys and studies. [Still missing are all cultural resource inventories, including the amended pipeline route].

Section 4.10 contends there would be no project-related advers visual impact to Saint Croix Island International Historic Site.

Roosevelt Campobello International Park stated any LNG development on the St. Croix River or in Passamaquoddy Bay would be inappropriate.

St. Croix International Waterway Commission is concerned about potential disturbance or loss of native species and habitats having high ecological or cultural significance. The project could result in loss of archaeological or historical resources within the waterway corridor.

Native tribes are concerned about tribal access to traditional activities. The Passamaquoddy Tribal Historic Preservation Officer requests a survey be conducted covering the LNG terminal site, waterway, and pipeline route. The Bureau of Indian Affairs expressed concern the project might affect resources important to the Passamaquoddy Tribe. The Passamaquoddy Tribe is concerned about impacts to salmon and river access. They oppose the pipeline encroaching on Indian trust lands. St. Mary's First Nations expressed concerns regarding impacts on their fishing and sustenance rights, on right whales and other whales.

Other native organizations expressed concerns about preserving treaty rights. Downeast LNG claims the Passamaquoddy Tribe has no fishing or sustenance rights within the Downeast LNG project’s waters. The Coast Guard’s Waterway Suitability Rreport includes a recommendation that Downeast provide written verification of collaboration with and acceptance from the Passamaquoddy Tribe.

To concerns about impacts on Head Harbour Lightstation, Downeast LNG states LNG ships would come no closer than 1,500 feet to Campobello Island. [Webmaster’s Note: 1,500 feet falls withing Hazard Zone 1, the most dangerous of the three Federal Hazard Zones.]

Plus, more.
