Summary (updated 2011 Jan 4): On 2012 Jan 3, DeLNG filed a response to FERC's 2011 Oct 18 Information Request, question No. 3. Answers were due on 2011 Nov 8, and on Dec 19, 2011, DeLNG promised to provide a response to one of the four outstanding questions "no later than Dec 31." DeLNG continues its deadline abuse regarding the other 2–3 outstanding questions.

The FERC request was:

"Update as necessary information on the U.S. Environmental Protection Agency’s Resource Conservation and Recovery Act (RCRA)* sites in the project vicinity." [Bold emphasis added.]

The question is concerning the U.S. Environmental Protection Agency's Resource Conservation and Recovery Act sites within the DeLNG ship HAZARD ZONES 2 & 3. DeLNG provides a list of RCRA sites that fall within these Hazard Zones (in the USA):

  • Irving Eastport Mainway
  • Maine Pearl Essence
  • R&M IGA
  • S.L. Wadsworth & Son
  • Engelhard Corporation
  • Fiber Extrusion Incorporated

Facilities of similar environmental concern in Canada that would fall within the Downeast LNG proposed ship Hazard Zones are ignored.


* Summary of the U.S. Environmental Protection Agency's Resource Conservation and Recovery Act (RCRA):

"The Resource Conservation and Recovery Act (RCRA) gives EPA the authority to control hazardous waste from the 'cradle-to-grave.' This includes the generation, transportation, treatment, storage, and disposal of hazardous waste. RCRA also set forth a framework for the management of non-hazardous solid wastes. The 1986 amendments to RCRA enabled EPA to address environmental problems that could result from underground tanks storing petroleum and other hazardous substances."

Summary: FERC asks Downeast LNG to supply US DOT PHMSA (Pipeline Hazardous Materials Safety Administration) input parameters, assumptions used, and results of the LNG vapor dispersion hazard modeling analysis in a public-information filing (but non-public treatment of certain portions of the analysis is allowed) within 20 days. A list of 13 questions requring answers is provided by FERC, to be answered by Monday, Feb 20. Downeast LNG clearly has not complied with US DOT vapor dispersion Exclusion Zone-calculation requirements.
