FERC asks within 20 days of November 13 (by December 3) that DeLNG provide its operational capabilities if Maritimes & Northeast Pipeline will not expand to accommodate DeLNG. |

Downeast LNG's ship-whale strike mitigation measures were discussed, but have not been finalized. They must be submitted to NOAA in order to be finalized. Also discussed were acoustic harassment, timing of construction activities, and impacts on marine fishery resources regarding a compensatory mitigation plan, that also has not been finalized. Another topic was Horizontal Directional Drilling (HDD): "Downeast would not propose alternate construction methods or site-specific contingency plans in the event of HDD failure because this would be done on a case-by-case basis…." FERC's Shannon Crosley indicated that that could cause a significant delay. As of Nov 16, Downeast LNG is 133 days late meeting FERC's 2009 July 6 deadline. That is 43 days more than the 90-day extension requested by Save Passamaquoddy Bay — that Downeast LNG objected to, claiming it would unnecessarily delay the process. Downeast LNG has already delayed the process nearly 50% longer than SPB's request, and Downeast LNG still has not provided FERC with all the required information. |
